New York State legalized electric scooters statewide in 2020, and New York City has allowed them on streets and in bike lanes ever since. What trips people up is not whether they are legal - it is the four separate rules that apply at once: a state speed limit, a state device limit, a city certification requirement for the scooter you buy, and an age and helmet rule. Are electric scooters legal in New York City?
Yes. Electric scooters are legal to own and ride in New York City. New York State Vehicle and Traffic Law Article 34-D, added in 2020, defines an electric scooter and sets the rules for operating one, and New York City permits riding on streets and in bike lanes.
Under VTL § 114-e, an "electric scooter" is a device with handlebars and a floorboard or seat, powered by an electric motor, that cannot go faster than 20 mph on a paved level surface when powered solely by the motor. A device that can exceed 20 mph is not an electric scooter under New York law - it is treated as a moped or a motor vehicle, with registration, licence and insurance requirements attached.
How fast can you legally ride an electric scooter in NYC?
15 mph. VTL § 1282 states that no person shall operate an electric scooter in excess of fifteen miles per hour. That is the operating limit, and it applies everywhere in New York State, including every street and bike lane in New York City.
This is separate from the 20 mph device limit. The scooter may be built to reach up to 20 mph; you may not ride faster than 15 mph. Both numbers are real and they do different jobs.
Can you ride an electric scooter on the sidewalk in NYC?
No. VTL § 1282 prohibits operating an electric scooter on a sidewalk except where a local law or ordinance authorizes it, and New York City has not authorized sidewalk riding. You may park a personal scooter on the sidewalk as long as it does not obstruct pedestrians.
Where can you ride an electric scooter in New York City?
On streets with a posted speed limit of 30 mph or less, and in bike lanes. VTL § 1282 restricts electric scooters to highways posted at thirty miles per hour or less, which covers the overwhelming majority of NYC streets. Highways, expressways, bridges with no bike path, and tunnels are off-limits.
The New York DMV also notes that municipalities can further regulate the time, place and manner of operation, so local rules can be tighter than the state baseline.
How old do you have to be to ride an electric scooter in NYC?
16. VTL § 1282 states that no person less than sixteen years of age shall operate or ride as a passenger upon an electric scooter. Shared-scooter rental programs generally set their own higher minimum of 18.
Do you need a helmet to ride an electric scooter in NYC?
Riders aged 16 and 17 must wear a helmet. Adults 18 and over are not legally required to, though New York State's Governor's Traffic Safety Committee recommends one for every rider. Municipalities have the authority to impose their own helmet requirements, so check before you ride outside the city.
Do you need a licence, registration or insurance for an electric scooter in NYC?
No, no and no. The New York DMV states plainly that an electric scooter cannot be registered. There is no licence requirement to operate a personal electric scooter, and no state insurance mandate. Note that standard auto policies generally exclude e-scooters; if you want liability coverage, ask your renters or homeowners insurer what your policy already does and does not cover.
What is Local Law 39, and does it apply to the scooter you buy?
Local Law 39 of 2023 is a New York City law governing what may be sold, leased second-hand or rented in the city - not what you may ride. It requires that:
- Electric scooters and similar powered mobility devices be certified to UL 2272
- The lithium-ion batteries that power them be certified to UL 2271
- Electric bicycles be certified to UL 2849
Enforcement sits with the Department of Consumer and Worker Protection. Local Laws 49 and 50 of 2024 raised the maximum penalty to as much as $2,000 per device type and gave the city authority to padlock a retailer that repeatedly sells uncertified devices, according to the City of New York.
This is the rule that matters most when you are choosing which scooter to buy, and it is also the rule most residential buildings have adopted informally: if a building asks whether your scooter is "certified," UL 2272 for the scooter and UL 2271 for the battery is the answer it is looking for. Legal is not the same as safe — what else to check
Local Law 39 of 2023 makes UL 2272 certification a condition of sale in New York City, but certification is the floor rather than the whole picture. Is an electric scooter the same as an e-bike or a moped under New York law?
No. New York law treats three categories differently, and the distinction decides whether you need a licence.

The practical consequence: if you buy a "scooter" that can do 30 mph, you have not bought an electric scooter in the eyes of New York law. You have bought an unregistered moped, and it is not legal to ride on a city street without registration, a licence and insurance.
Which Metro America scooters are legal to ride in NYC?
Both of them, on all four counts.

- Both are UL 2271 and UL 2272 certified, with testing performed by the accredited SGS laboratory, which is what Local Law 39 requires of a scooter sold in New York City

- Both pair with the METRO+ app, which includes selectable speed modes so you can hold the scooter to the 15 mph legal limit, plus GPS tracking and remote locking

Electric Scooter Law in NYC: Quick Answers
Can I ride an electric scooter in a New York City bike lane?
Yes. Electric scooters are permitted in NYC bike lanes and on streets posted at 30 mph or less, subject to the 15 mph operating limit in VTL § 1282. They are not permitted on sidewalks.
Can the police stop you for riding an electric scooter in NYC?
They can stop you for the same reasons they would stop a cyclist: riding on the sidewalk, riding above 15 mph, running a red light, riding under 16, or riding at 16 or 17 without a helmet. Riding a legal, certified electric scooter on a street or in a bike lane is not itself a violation.
Can my building stop me from bringing an electric scooter inside?
A building can set its own policy on storing and charging lithium-ion devices, and many New York buildings now do. In practice most of those policies turn on certification: a scooter certified to UL 2272 with a UL 2271 battery is what buildings and insurers ask for, and it is what Local Law 39 requires of anything sold in the city. Ask your management for the policy in writing and check which standards it names.
Are electric scooters legal on the sidewalk anywhere in New York?
Only where a municipality has passed a local law authorizing it. VTL § 1282 bans sidewalk operation by default, and New York City has not created an exception. You may park on a sidewalk if you do not obstruct pedestrian passage.
What happens if my scooter can go faster than 20 mph?
It is no longer an electric scooter under VTL § 114-e. Devices capable of more than 20 mph fall into the moped or limited-use motorcycle classes, which require DMV registration, a driver licence and insurance to operate on public streets.

Which certified scooters can you actually buy in New York City?
Legal to ride is settled by NY VTL § 1282; legal to buy is settled by certification, because under Local Law 39 of 2023 only a scooter certified to UL 2272 with a UL 2271 battery may be sold in New York City at all.
